Terms of Service — Gold Bullion Live Pricing
Last updated:
Draft for legal review. This text has not yet been reviewed by a lawyer and may change before the app is published.
1. Agreement
These terms are an agreement between Qode Bites (“we”) and the merchant who installs Gold Bullion Live Pricing on a Shopify store (“you”). By installing or using the app you accept them. They apply in addition to Shopify's own terms for merchants and apps.
[OWNER: …] marks a point the owner must decide before publication.
2. The service
The app rewrites the prices of the product variants you configure from the gold rate of your market, supplied by Gold Bullion (goldbullioneg.com), using your gold weights, markup and making charge. It writes variant prices, the gbgold.last_priced_at metafield, the gbgold metafield definitions (created once when you install), the gbgold.gold_weight_g metafield when you confirm a weight import, and compare-at prices when you restore a snapshot. It changes nothing else in your store. Markets in version 1: Egypt, Saudi Arabia and the United Arab Emirates — gold, and silver in Egypt. Kuwait, Qatar, Bahrain and Oman are supported by the app, but the feed publishes no rates for them at present, so stores in those markets cannot be priced until it does.
3. Plans and fees
Plans are priced on variants under management — variants that have a karat and a gold weight. Charges are in US dollars, billed by Shopify on your Shopify invoice (Shopify may convert them to your billing currency), and recur every 30 days:
| Plan | Includes and price |
|---|---|
| Starter | Up to 250 variants under management — USD 29 per 30 days |
| Growth | Up to 2,000 variants under management — USD 79 per 30 days |
| Pro | Up to 10,000 variants under management — USD 199 per 30 days; above 10,000: USD 0.02 per variant per 30 days, charged daily (prorated), capped at USD 300 per 30 days |
- Starter and Growth: variants above the plan's limit are not priced (they are held as “tier limit”) until you move to a larger plan.
- Pro: variants above 10,000 are priced and billed as usage through a separate capped usage line that you approve with the subscription: USD 0.02 per variant per 30 days, charged once a day for the previous day (USD 0.02 ÷ 30 per variant per day, rounded down to the cent), never more than the cap you approved (USD 300 per 30 days unless you raise it in Shopify). When the cap is reached, no further usage is charged in that billing period.
- Overage usage charges are made only while we have overage charging switched on. It is currently switched off; we will give notice in the app at least [OWNER: notice period, e.g. 30 days] before switching it on.
- Taxes are handled by Shopify according to its billing terms.
We may change prices for future billing periods with notice in the app; a price change takes effect only once you approve it in Shopify.
4. Free trial
Each plan starts with a 7-day free trial of the recurring charge, granted once per store: switching plans or reinstalling does not start a new trial, only the rest of the first one remains. No usage (overage) charge is made for any day that falls inside the trial. Prices are written to your store only after you have approved the first-sync preview and a plan is active (trial included).
5. Cancellation
You can cancel at any time by uninstalling the app or cancelling its subscription in your Shopify admin. Billing, proration and refunds of charges are handled through Shopify's billing system and its rules. [OWNER: our own refund policy, if any, beyond Shopify's billing rules.]
When your subscription is cancelled, frozen or expires, the app stops writing prices (it checks your subscription at least every hour and every time you open it). Prices already written stay in your store. To put your original prices back, use “Restore original prices” before you uninstall: after uninstalling, the app can no longer reach your store.
6. Use of the Gold Bullion rates (licence)
While your subscription is active you may display, in your own Shopify storefront, prices that the app computes from the Gold Bullion feed. You may not resell, redistribute, publish or otherwise make available the raw Gold Bullion rates themselves, whether through the app, an export, an API, a feed or any other channel. Your right to use the rates ends when your subscription ends.
The rates and the feed remain the property of Gold Bullion (goldbullioneg.com); we grant you only the limited right in this section, for as long as your subscription is active.
7. Your responsibilities
- Setting the app up correctly: market, collection-to-karat mappings, gold weight of each variant (never the shipping weight), markup, making charge, rounding and safety-rail limits.
- Reviewing the before-and-after preview of the first sync before you approve it. Approving it authorises the app to write those prices; you are responsible for checking them.
- Checking that the prices shown in your store, and how you present them, comply with the law where you sell (for example consumer-protection, price-display and tax rules).
- Keeping the app's metafields accurate and using the kill switch when you need every write to stop at once.
8. Safety rails are best effort
The app checks every computed price before writing it: a maximum change per variant (default 5 % from the last written price — the variant is held), a price floor (metal at the buy-back rate plus making charge — held), a feed-sanity check (a karat rate moving more than 10 % since the last accepted rate aborts the run), a feed-health check (errors or a zero or missing rate abort the run and keep the last prices), hidden karats (skipped), and a currency check (your store currency must match your market's; otherwise every write is held). When a rail trips, the existing price stands.
These rails, the first-sync approval and the kill switch are designed to fail safe, but they are provided on a best-effort basis. They reduce the risk of a wrong price; they do not guarantee that every price written is correct, and they are not a substitute for your own review.
9. No warranty on third-party rates
Gold rates are set by Gold Bullion (goldbullioneg.com) — Egyptian rates are entered by an operator and move irregularly — and are passed through by the app. We do not guarantee that a rate is accurate, complete, current or available at any time. Rates may be delayed, change between two syncs, or be withheld; a market may report no usable rate.
10. Prices captured at checkout
Shopify keeps the price that was current when a checkout was created. A customer who started checkout before a price change still pays the earlier price, even after the app has written the new one. This is standard Shopify behaviour, not a failed sync: new carts and checkouts get the new price.
11. Availability and changes
We aim to keep the app available but do not promise uninterrupted service; maintenance, Shopify incidents, rate limits or feed outages may delay syncs. We may change or improve the app; if we remove a feature you pay for, we will tell you in advance in the app.
12. Disclaimer
Except as required by law, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or goodwill, including losses from selling at a price the app wrote or failed to write. Our total liability for any claim relating to the app is limited to the fees you paid for the app in the [OWNER: period, e.g. three] months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
14. Suspension and termination
We may suspend or end your access if you breach these terms (in particular section 6) or use the app unlawfully. On termination, your right to use the rates ends and your store data is deleted as described in the privacy policy.
15. Governing law
These terms are governed by the laws of [OWNER: governing law], and the courts of [OWNER: jurisdiction] have jurisdiction, unless the law of your country requires otherwise.
16. Changes and contact
We may update these terms; the date at the top shows the current version, and material changes are announced in the app before they apply. Questions: Qadi@qodebites.com.
